This agreement is between you and The Whisky Index Ltd, trading as The Whisky Index and The Index Registry. We're registered in England and Wales, company number 17216416, registered office 71–75 Shelton Street, Covent Garden, London WC2H 9JQ. "We", "us" and "our" mean The Whisky Index Ltd.
By ticking "I agree" when you apply, you accept this agreement. It applies once we approve your application.
1.1 As an ambassador, you share links to eligible products with people who may want them. If someone buys through your link and the sale qualifies, you receive a reward.
1.2 Eligible products are shown in your ambassador account. At launch, these are whisky casks sold by The Whisky Index. We'll add products from other retailers as they join, and your account will show which are eligible.
1.3 You introduce buyers, and that's all. You don't sell anything, take payment, negotiate, or agree anything on our behalf or on behalf of any retailer.

3.3 For whisky casks, use only the approved posts in your account. You may add one short personal line after the Ad line and before the approved post, as long as it follows section 4.

4.2 You must only say things that are true and that match the product page. Don't make up facts, scarcity, deadlines or reviews.
4.3 Alcohol. When you share anything about whisky, you must:
If you're aged 21 to 24, share text posts only, with no cask images. Your account will show only the posts you can use.
4.4 Conflicts. Don't refer anyone you advise or act for in a professional capacity, such as a client you advise on money or a business you buy for, unless you've told them about your reward in writing first.
5.1 The rates. The reward for each eligible product is shown in your account and on the product before you share it.
For whisky casks, the reward is a percentage of the cask price the buyer pays at checkout. Later charges, such as storage renewals, regauging, bottling and duty, never count. The rates are:

For products from other retailers, your reward is half of the commission or fee that retailer pays us for the sale, under its agreement with us. The amount is shown on each eligible product. Products we list through affiliate networks are not eligible.
5.2 A sale qualifies when all of these are true:
5.3 When a sale moves through each stage, your account shows it as pending, then payable, then paid.
6.1 We pay each reward within 5 working days of it becoming payable, with no minimum amount. We pay by bank transfer to a UK bank account in your name, through our payment provider, Stripe. Stripe emails you a secure link to enter your bank details; we never see your full bank details.
6.2 If a buyer is refunded or a sale is reversed after we've paid you for it, we'll take that amount off your future rewards.
6.3 We may hold a payment while we investigate suspected fraud or a breach of this agreement. We'll tell you why, unless the law prevents us.
6.4 Tax. You're responsible for your own tax and National Insurance on your rewards. If you're VAT registered, tell us and send an invoice. We may share information about payments to you with HMRC where the law requires it.
You're independent. You're not our employee, worker, agent or partner, or a retailer's. You can't make any promise or agreement on our behalf. You choose when and how much you share. There is no salary, target or guaranteed amount.
8.1 You can leave at any time from your account, or by emailing us.
8.2 We may end this agreement:

We'll give you at least 15 days' notice of any change to this agreement or to reward rates. A change never affects a sale made before it takes effect. If you don't agree with a change, you can leave before it applies.
We use your information as explained in the ambassadors section of our privacy notice. You'll see when a sale through your link happens and its value. You won't see who the buyer is.
11.1 You're responsible for what you post. You agree to cover any loss we suffer because you broke this agreement or the law.
11.2 Limits on what we owe you:
Nothing in this agreement limits liability that can't legally be limited.
This agreement is governed by the law of England and Wales, and the courts of England and Wales decide any dispute. If any part is found unenforceable, the rest still applies. Questions: toby@theindexregistry.com.
